Payment and Fees
Payment for our services must be made in full prior to the commencement of the project, unless otherwise agreed upon in writing. We reserve the right to charge interest on overdue payments at a rate of 1.5% per month or at a rate that we have discussed during the contract. Any additional costs or fees incurred during the project will be discussed with the client and agreed upon in writing prior to incurring the cost.
Any intellectual property created by GAC Infotech during the course of the project remains the property of GAC Infotech unless otherwise agreed upon in writing. The client may use any intellectual property created by GAC Infotech solely for the purpose for which it was created. This includes any intellectual property related to our services, such as CCTV camera installation, computer and laptop rental, CRM installation, server and gateway installation, biometric machines, video door locks, LAN networking, and security alarms. know more about services
While we strive to provide the best possible IT solutions, we cannot guarantee that our services will be error-free or uninterrupted. GAC Infotech will not be liable for any indirect, consequential, or special damages arising from the use of our services, including but not limited to loss of profits, loss of data, or interruption of business operations. Our liability for any direct damages arising from the use of our services shall not exceed the amount paid by the client for the services.
Either party may terminate the project at any time by giving written notice to the other party. If the project is terminated by the client, the client shall be responsible for any costs incurred by GAC Infotech up to the date of termination. This includes any costs related to our services, such as CCTV camera installation, computer and laptop rental, CRM installation, server and gateway installation, biometric machines, video door locks, LAN networking, and security alarms.
Payment Terms and Conditions
GAC Infotech requires payment in full upon completion of services, unless otherwise agreed upon by both parties. Invoices will be sent electronically to the customer’s email address or via WhatsApp or any other social platform provided during the contract signing process or during the deal, whether physically or electronically. Payment can be made via bank transfer, credit card, or other agreed-upon methods.
For rental services, payment will be required in advance and will be based on the agreed-upon rental period. Late fees may be applied for overdue payments.
For hardware and equipment purchases, payment will be required in advance or as agreed upon in writing by both parties.
By using GAC Infotech’s services, you agree to receive communications from us electronically, including email and messages posted on our website. You acknowledge that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
All intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, patents, and other proprietary rights, in and to the products and services provided by GAC Infotech shall remain the sole and exclusive property of GAC Infotech.
Feedback and Suggestions
GAC Infotech welcomes feedback and suggestions from our customers. By submitting any feedback or suggestions to us, you grant GAC Infotech a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such feedback or suggestions in any media or format.
GAC Infotech may use third-party services, including but not limited to hosting, email, and payment processing services, to provide our products and services. You acknowledge and agree that GAC Infotech shall not be held responsible for any acts or omissions of such third-party services and that your use of such services is subject to their respective terms and conditions.
Limitation of Liability:
GAC Infotech will not be liable for any damages resulting from the use or inability to use the services provided. We will not be liable for any indirect, special, or consequential damages arising from the use of our services.
You agree to indemnify and hold GAC Infotech and its employees, agents, and affiliates harmless from and against any claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of your use of our products and services or any breach of this agreement by you.
During the term of this agreement and for a period of one year thereafter, the customer shall not solicit or hire any employee or contractor of GAC Infotech without our prior written consent.
The provisions of this agreement that, by their nature, should survive termination, including but not limited to warranty and liability, confidentiality, governing law and jurisdiction, intellectual property, and indemnification, shall survive any termination or expiration of this agreement.
Relationship of Parties
The parties to this agreement are independent contractors, and nothing in this agreement shall create any partnership, joint venture, agency, or employment relationship between the parties.
The headings used in this agreement are for convenience only and shall not affect the interpretation of this agreement.
This agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same instrument.
Neither party shall be liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to acts of God, fire, flood, war, terrorism, or labour disputes.
The customer may not assign its rights or obligations under this agreement without the prior written consent of GAC Infotech.
Any waiver of a breach of this agreement by either party shall not be deemed to be a waiver of any subsequent breach.
Any notice required or permitted under this agreement shall be in writing and shall be deemed given when delivered in person or by certified mail, return receipt requested, to the address of the other party specified in this agreement.
If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
GAC Infotech values the privacy and confidentiality of its customers and their data. All customer information and data collected during the course of our services will be kept confidential and will only be used for the intended purpose.
Warranty and Support Policy
GAC Infotech provides a warranty on all hardware and equipment purchases, as specified in the product documentation. We will provide support and assistance in the event of any issues with the hardware or equipment during the warranty period.
For software- and service-related issues, we provide technical support to our customers. The scope and duration of support will depend on the specific service and the terms agreed upon by both parties.
Either party may terminate the contract by providing written notice to the other party. In the event of termination, the customer will be required to pay for all services rendered up to the date of termination.
GAC Infotech may also terminate the contract if the customer breaches any of the terms and conditions outlined in the contract or if the customer fails to pay for services rendered.
These terms and conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts of Indore. This applies to any disputes related to our services, such as CCTV camera installation, computer and laptop rental, CRM installation, server and gateway installation, biometric machines, video door locks, LAN networking, and security alarms.
Changes to Terms and Conditions
GAC Infotech reserves the right to change these terms and conditions at any time without prior notice. It is the responsibility of the client to regularly review these terms and conditions for any changes. We will provide notice of any material changes to these terms and conditions.
